At our cookout this past weekend, several homeowners voiced concerns to the Board members that McBride is not making warranty repairs in a timely fashion and will not return phone calls or respond to letters. A letter was sent to Ben Tarwater, the Project Manager for our development this morning advising him of these issues. In his response, he states "We make it our mission to respond to those customer initiated concerns quickly."

If you have any warranty issues that need attention or that have been ignored previously by McBride, please see that you contact them again either by phone at 816-505-4747, ext. 157 or via email at kcservice@mcbridehomes.com. Hopefully, they will get your problems taken care of promptly.

We had 44 people come out for our potluck cookout last evening! I think everyone enjoyed visiting with their neighbors and meeting some of the new people who have moved in. The food was great! A special thanks to Allen Swicegood for grilling all the hamburgers and hot dogs and to Dale Whitney who fried up some fish he had caught! Everything was delicious!

Several people expressed an interest in having a similar event again later in the summer or early fall. Any suggestions out there? One idea was to have everyone make their favorite chili or soup...another idea was to have an ice cream or dessert social. Let us know what you think!

Homeowners who plan to lease their houses need to be sure they are in compliance with section 11 of our indentures, found on page 33. It reads as follows:

Each owner shall have the right to lease or rent their Single Family Dwelling for single family residential purposes only, subject to the following requirements:

(a) Every lease or rental agreement shall be in writing and shall be subject to all provisions of this Indenture as amended from time to time. Further, the lease or rental agreement shall be deemed to incorporate the Rules and Regulations of the Association by reference and shall include the provisions that any violations of (a)the Rules and Regulations; ((b)the Indentures as amended; or (c)the covenants and conditions of the lease or rental agreement itself other than nonpayment of rent, shall be the basis for termination of the lease or rental agreement.

(b) Every proposed lease or rental agreement shall be subject to the Directors approval so as to assure compliance with this Section.

(c) Every lease or rental agreement shall appoint the Board in its sole and absolute option and discretion, to act as an agent for the Owner for the purpose of enforcing the terms, covenants and conditions of the lease or rental agreement, other than the non-payment of rent. If any such violation is not cured within thirty (30) days or such shorter time that may be provided in the lease or rental agreement, the Directors shall have the right of action to evict or otherwise terminate the lease or rental agreement or the tenant's possession to the Single Family Dwelling under the Rent and Possession Laws or Unlawful Detainer Laws of the State of Missouri. The Directors shall have no liability to the Owner or the tenant on account of any action taken to evict or otherwise terminate the lease of the tenant's possession of the Single Family Dwelling.

(d) Every lease or rental agreement shall have a minimum initial term of one (1) year.

(e) Every lease shall be subject to the Rules and Regulations as promulgated by the Directors from time to time.

Potluck Cook-out

We are hosting a potluck cook-out for our HOA again this year! The development is completed now so come out and meet your neighbors! We will be cooking hamburgers and hot dogs and ask that everyone bring something to go with them (baked beans, salads, chips, cookies, etc.). We will also have ice tea and lemonade but you are welcome to bring any other beverages you like. One more thing...lawn chairs! We have tables to use but do need more lawn chairs so if you can bring enough for your household, that would be great! We have set a rain date for the following Saturday, just in case the weather is bad that day. Please give us a call and let us know how many from your household will be attending so we can be sure to have enough burgers and hot dogs for everyone! Hope to see you there!

The Board members are going to start taking a serious look at the by-laws and indentures that McBride set up for our HOA. Obviously, this is going to be a big undertaking. A lot of the material included was put in to give McBride control while they were still building homes but isn't really necessary to have, now that the development is completed. We are going to attempt to remove all of those types of items which should make the remaining ones easier to read and understand. However, we would like to request your help. Please look over the indentures and let us know what you think of them...should they stay...should they go...should they be revised. Some of the indentures could be quite costly for the homeowners if left the way they are, some of them are very difficult to enforce. We need to know what the homeowners think of them. You can post your comments here by clicking the 'send feedback' button below or you can email us through the 'contact' tab at the top of the page.

Once we go through the indentures and come up with our suggestions, we will schedule a homeowners meeting for everyone to attend. At that time, we will discuss everything as a group and then vote on what changes should be made. In the mean time, though, we would really appreciate some input from all of you.

Due to some recent situations and concerns, our Board members have decided it is in the best interest of our community to work independently instead of in conjunction with the Board members from the Barrington Woods HOA. This website is set up for the Barrington Ridge members which consists of the villa homes in The Reserve and the last 11 homes built in the Estates which are located on NE 98th Terrace and all back up to the walking trail.

We wish to thank everyone for your patience and understanding while we have worked on learning what all needs to be done to run an effective HOA. The Board has received several comments from homeowners regarding the mulch vs. rock issue in the beds around the front of the homes. Most people seem to favor the rocks going in over continuing the mulch but the cost of doing all of the homes with rock is too great for us to handle at this time since we are such a new HOA and have limited funds. Additionally, those who still want the mulch are very adamant in their choice and we do not feel it is fair to force something on any homeowner that they don't want. Therefore, the Board has decided to go ahead and put mulch in the beds at this time. However, we feel we should allow any homeowners who wish to install rock on their own to do so as long as it is done with a proper edging material used to define the beds. Homeowners need to submit an Architectural Modification Request Form to Nilla Henry at Curry Management outlining your plans and what materials you intend to use. If you plan to install rock in the next few weeks and would prefer not to have new mulch added to your shrub area, please let Nilla know as soon as possible and she will see that no mulch is installed at your home. Thank you for your input in this matter.

There have been several complaints about cars parking on the streets overnight. Our Indentures for the development state:

"Personal property including without limitation, boats, trailers, trucks with a gross vehicle weight in excess of five (5) ton, campers, and recreational vehicles, shall not be placed or stored permanently or temporarily in the open or in an enclosed carport on any Lot, nor shall they or any motor vehicle of any type or description be parked for any time on the unpaved portion of any Lot or on any street 'overnight'. For purposes hereof, overnight shall be defined as being any time between the hours of 12:00 AM and 8:00 AM"

If you have overnight guests, they need to park their vehicles in your driveway. Please be sure that vehicles are not parked so they block other residents' driveways or mailboxes. Thanks for your help and understanding!
