A new management company will be handling our properties for the next year. Our November dues will still be sent to Curry Association Management but starting in December, payments will be sent to Hunter Residential. They are sending out letters to everyone giving their contact information and advising where to send your monthly payments. If you don't receive a letter from them within the next week, please call Terry Langford at 816-926-9949 or email him at terry@hunterresidential.com and let him know. We think this is going to be a great change for our community and are looking forward to working with Terry. Letters will also be going out in November with information about our annual dues to take care of the common grounds for 2009.

There were four major items voted on at our meeting this past week involving the changes to our indentures. The first vote was to remove all references to the "Declarant" as they are currently listed. The "declarant" was McBride & Son Homes and they are no longer involved in the HOA.

The second item that was changed is the insurance. It was decided to delete insurance coverage for the individual properties from the HOA responsibilities and allow each homeowner to purchase their own homeowner policy to cover their home and possessions. This take effect when our current policy expires in April 2009. Each homeowner will be able to purchase their policy from whatever company they wish, with the amount of coverage they want and pay the deductible they want instead of accepting whatever the Board of the HOA decides. Reminders will be sent to everyone as the expiration date of the current policy gets closer.

The third item that was voted on was to change Section 9 (r) to include: The Directors shall provide care and/or maintenance to each Villa Lot, which is subject to assessment hereunder, as follows: care for grass, trees and shrubs (except those trees and shrubs installed by the Owners with the Directors' permission).

The last item that was voted on was to change Section 9 (r) to include: Exterior maintenance upon each Villa Lot and the Single Family Dwelling located on such Villa Lot which is subject to assessment hereunder, for roofs, gutters, shutters, siding, downspouts, glass surfaces, exterior doors, walks, garage doors, awnings, window boxes, doorways, doorsteps, air conditioning units, stoops, mail boxes, light fixtures, utilities, utility meters, porches, balconies, windows, fences, sidewalks, decks, patios or driveways are the responsibility of the individual homeowner. An Owner of a Villa Lot shall not have the right to apply a different color paint/stain or quality (other than the same color or stain and quality as originally provided by the builder)to doors, decks, patios or fences without prior written approval by the Directors.

Basically, the Indentures listed some of the above items to be the responsibility of the homeowners and some of them to be done at the 'discretion of the Board'. These votes defined that all maintenance to the homes and not just parts of the home, are the homeowners' responsibility and that the HOA will take care of the lawns, trees and shrubs (that were installed by the builder). This way everything is defined and there is no 'discretion of the Board' involved.

Copies of the new Indentures will be going out in the next couple of weeks.

It was great to see so many homeowners at our meeting last night! Thank you to everyone who came out to vote on changing our indentures to help make our community a great place to live. The Board will now get everything written with our new changes and filed with the county. As soon as this is completed (hopefully, within the next 2 - 3 weeks), we will distribute copies to all homeowners.

In addition to getting the new indentures in place, the Board will be working on our 2009 budget and will be getting that information to everyone in November.

Please remember that in order to be able to vote at the special meeting on October 16th, you must be current on your monthly and annual dues. This is clearly stated in Section 2 a (iii) of the Indentures (page 5). You are welcome to attend the meeting but cannot vote if you are behind on your dues or fees.

The Board of Directors is calling a special meeting of the homeowners on Thursday, October 16, 2008 at 6:30 PM. The meeting will be held in the Blue Room of the Liberty Community Center, 1600 S. Withers Rd. This is a very important meeting for homeowners as we will be voting on several changes to the Indentures for this development. While reviewing the Indentures, the Board has found several areas of concern that need to be addressed. These topics will be discussed and a vote taken as to how to handle them. Theoretically, as few as 4 homeowners can change the Indentures that everyone has to live by, so it is important to have as many homeowners in attendance as possible. A letter is being mailed out this week from Curry Management to each homeowner. A proxy is being included with the letter. If you are unable to attend the meeting, you can sign your proxy vote over to one of the board members or one of your neighbors who will be attending, to vote on your behalf. However, according to the Indentures, all proxies must be filed at least 48 hours prior to the meeting, so our Secretary, Laura Cavazos must have your proxy, no later than 6:30 PM on Tuesday, October 14th for it to count. There will be contact information included in the letter if you have any questions. Please mark your calendar and plan to attend!!

Game Night is tonight! Starts at 6:30 this evening at the Swicegoods' house. Bring lawn chairs, finger food/snacks to share and your favorite board or card game to play. Hope to see you tonight!

We have a lot of dog owners in our area and it is causing some concerns. There are people out there and you know who you are, who never clean up after their dogs, allow their dogs to run without a leash, and who allow their dogs to sit on their decks or patios barking at all hours of the day. This is not acceptable and not being responsible dog owners. Any time your dog is out of your house or your fenced yard (if applicable), it is required by the city to be on a leash. Any time your dog messes, it is your responsibility to clean it up...even if it is in your own yard. Dog feces can cause a long list of health issues. Again, this is required by the city. Your dog barking at 6 AM or 11 PM and disturbing your neighbors is also not allowed by the city. All of these offenses carry fines and the possibility that your dog be taken away from you by animal control. These problems are not the dog's fault, they are the owner's responsibility. The city will be asked to take action if these problems are not addressed. For those of you who do take care of your dog and their messes...Thank you! Hopefully, others will follow your example!

I am sure everyone has noticed already but we have a new lawn care company that will be finishing out the year for us. Messenger Lawn Service was out yesterday and mowed our lawns and common areas and did a super job! The area looks the best it has all year. They will be doing all of our fall treatments to the lawns as well.
